Terms and Conditions - Gym No Joining Fee

1. For Virgin Active this offer is only open to new Vitality customers who purchase a qualifying VitalityHealth and/or VitalityLife policy between 3 January and 15 February 2017 only.
 
2. For Nuffield Health this offer is open to new customers who purchase a qualifying VitalityHealth and/or VitalityLife policy between 3 January and 15 February 2017 and existing members with a qualifying policy.
 
3. Qualifying policies for the Virgin Active offer are: 
a) VitalityHealth Personal Healthcare members aged 18 years or over and eligible to take out a discounted Virgin Active gym membership under their VitalityHealth policy; and 
b) VitalityLife policies with Vitality Plus or Vitality Optimiser members aged 18 years or over and eligible to take out a discounted Virgin Active gym membership under their VitalityLife policy; 
in accordance with clause 5 below. These will be referred together as the “Eligible Members”.

4. Qualifying policies for the Nuffield Health offer are: 
a) VitalityHealth Personal, Business and Corporate Healthcare members aged 18 years or over and eligible to take out a discounted Nuffield Health Fitness & Wellbeing Clubs gym membership under their VitalityHealth policy; and 
b) VitalityLife policies with Vitality Plus or Vitality Optimiser members aged 18 years or over and eligible to take out a discounted Nuffield Health Fitness & Wellbeing Clubs gym membership under their VitalityLife policy;
 in accordance with clause 5 below. These will be referred together as the “Eligible Members”.

5. The offer only applies to Vitality flexible monthly gym memberships at Virgin Active and to new monthly gym memberships at participating Nuffield Health Fitness & Wellbeing Clubs. 

6. For new VitalityHealth Personal Healthcare members, a minimum monthly premium of £33 will apply. 

7. New VitalityLife members must have purchased Vitality Optimiser or Vitality Plus when they purchased their policy to take advantage of this offer. A minimum total monthly premium of £33.80 for single life policies and £47.60 for joint life policies also applies.
 
8. New Eligible Members shall be entitled to a “No Joining Fee” offer with Virgin Active and participating Nuffield Health Fitness & Wellbeing Clubs, valid until 28 February 2017 provided that the corresponding VitalityHealth or VitalityLife policy remains in force until this date and was purchased on or before 15 February 2017.

9. New Eligible Members must have provided, at the time of policy purchase, an active and regularly checked email address in order to receive access to this offer.

10. To redeem the offer at Virgin Active, Eligible Members must attend their selected Virgin Active club and present their offer email containing their unique code, Vitality membership number and policy start date, along with a proof of identity on or before 28 February 2017.
 
11. To redeem the offer at Nuffield Health, Eligible Members must attend their selected Nuffield Health Fitness & Wellbeing Club, present their membership number and a form of ID and join before 28 February 2017.  

12. The monthly membership fees shall vary depending on the club selected by the Eligible Member. 

13. The Virgin Active or Nuffield Health membership must begin on or before 28 February 2017 and Eligible Members will not be entitled to defer commencement of their gym membership.
 
14. This offer does not apply to Virgin Active’s Chiswick Riverside Health and Racquet Club. Please refer to www.virginactive.co.uk for further details. 

15. This offer applies to certain Nuffield Health Fitness & Wellbeing Clubs. For club participation please visit www.nuffieldhealth.com/gyms/services/vitality-membership.

16. All gym memberships taken up by Eligible Members in accordance with this offer can be cancelled at any time after the first full calendar month of membership by giving one month’s notice to the relevant Virgin Active or Nuffield Health Fitness & Wellbeing Club.

17. Where an Eligible Member has already purchased a Virgin Active gym membership at the date they become an Eligible Member (and they were not a Vitality customer at the time they joined Virgin Active), they may transfer their membership to a Vitality flexible monthly gym membership without paying a joining fee in accordance with the terms of this offer. For the avoidance of doubt, no joining fees paid at the time the existing gym membership was purchased shall be reimbursed.
 
18. Where an Eligible Member is already a member at a selected Nuffield Health club in a contract (either 12 months or 3 months) without the benefit of this offer, the Eligible Member will need to pay a transfer fee of £50 to transfer their membership to a Vitality membership. If a Nuffield member is not in a contract then they will be eligible for the offer as per the terms of the offer.
 
19. Any decisions made by Vitality over eligibility or otherwise in relation to the offer are final, will not be open to dispute and no correspondence will be entered into. 

20. Vitality reserves the right to substitute the offer with an offer of similar value in the event the Virgin Active or Nuffield Health Fitness & Wellbeing Club memberships are not available on the terms set out in these terms and conditions due to circumstances beyond Vitality’s reasonable control. 

21. Vitality is not liable to any person in any way in relation to the offer of the Virgin Active and Nuffield Health Fitness & Wellbeing Club memberships, except for any liability that cannot be excluded by law. 

22. Vitality accepts no responsibility for products and services provided by Virgin Active or Nuffield Health Fitness & Wellbeing Clubs.

23. Vitality reserves the right to vary, extend or withdraw the offer at any time, including in the event of fraudulent behaviour.
 
24. This offer cannot be used in conjunction with any other offer.

25. These terms and conditions shall be governed by English law, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.

Virgin Active terms and conditions apply and Eligible Members must agree to be bound by the Virgin Active club rules and satisfactorily complete a pre activity readiness questionnaire or health commitment statement as requested by Virgin Active.
