Gym offer terms and conditions
- For the purposes of these Terms and Conditions, references to the “Offer” herein shall mean, variously, the “No Joining Fee Offer” (as defined in clause 3), the “Enhanced VitalityLife Discount Offer” (as defined in clause 6) or both offers together, as the context requires.
- For participating Virgin Active and Nuffield Health Fitness & Wellbeing Clubs this Offer is open to:
a) Eligible VitalityHealth Members. For the purposes of these terms and conditions, “Eligible Health Members” are
(i) new customers aged 18 years or over who purchase a qualifying VitalityHealth plan between 1 January and 29 February 2020 inclusive; and
(ii) existing members with a qualifying VitalityHealth plan.
b) Eligible VitalityLife Members. For the purposes of these terms and conditions, “Eligible Life Members” are
(i) new customers aged 18 years or over who purchase a qualifying VItalityLife plan between 1 January and 29 February 2020 inclusive; and
(ii) existing members with a qualifying VitalityLife plan or policy.
These will be referred together as the “Eligible Members”.
- Qualifying plans or policies for the Virgin Active or Nuffield Health Fitness & Wellbeing Clubs offer are:
a) VitalityHealth Personal Healthcare plans with a minimum monthly premium of £35 and VitalityHealth Business and Corporate Healthcare plans; and
b) VitalityLife policies with Wellness Optimiser or Vitality Optimiser at an additional monthly fee of £4.50 that are purchased on or before 29 February 2020 and that are in force at midnight on 29 February 2020.
- The gym discount for members with Vitality Essentials as part of a Business Healthcare plan remains 40%, however members with Vitality Essentials will qualify for the No Joining Fee Offer.
- Eligible Members shall be entitled to a “No Joining Fee” offer with participating Virgin Active or Nuffield Health Fitness & Wellbeing Clubs valid until 15 March 2020 provided that the corresponding VitalityHealth plan or VitalityLife policy remains in force until this date (“the No Joining Fee Offer”).
- The No Joining Fee Offer only applies to new Vitality flexible monthly gym memberships at Virgin Active and to new monthly gym memberships at participating Nuffield Health Fitness & Wellbeing Clubs. Subject to clauses 13 and 14 (as applicable), the No Joining Fee Offer does not apply to any person who has previously held any membership at either a Virgin Active or Nuffield Health Fitness & Wellbeing Club.
- Eligible VitalityLife Members who take up the No Joining Fee Offer will also be entitled to receive 50% off the cost of their monthly gym membership fees for the duration of their membership (the “Enhanced VitalityLife Discount Offer”).
- The Offer is not available at any David Lloyd Clubs.
- To redeem the Offer at participating Virgin Active or Nuffield Health Fitness & Wellbeing Clubs, Eligible Members must visit their selected club, present their Vitality membership number along with proof of identity and take up the Offer on or before 15 March 2020.
- The monthly membership fees shall vary depending on the gym/club selected by the Eligible Member. Price increases may apply in line with the applicable membership terms and conditions.
- This Offer does not apply to Virgin Active’s Chiswick Riverside Health and Racquet Club and only applies to certain Nuffield Health Fitness & Wellbeing Clubs. For club participation please visit www.vitality.co.uk/gymlocations.
- All gym memberships taken up by Eligible Members in accordance with this Offer can be cancelled at any time after the first full calendar month of membership by giving one month’s notice to the relevant Virgin Active or Nuffield Health Fitness & Wellbeing Club.
- Where an Eligible Member has already purchased a Virgin Active gym membership at the date they become an Eligible Member, they may transfer their membership to a Vitality flexible monthly gym membership without paying a joining fee (transfer fee) in accordance with the terms of this Offer. For the avoidance of doubt, joining fees paid at the time the existing gym membership was purchased shall not be reimbursed by Vitality.
- Where an Eligible Member is already a member at a selected Nuffield Health Fitness & Wellbeing Club in a contract (either 12 months or three months) without the benefit of this Offer, the Eligible Member will need to pay a transfer fee of £50 to transfer their membership to a Vitality membership. If a Nuffield Health Fitness & Wellbeing Club member is not in a contract then they will be eligible for this Offer.
- Any decisions made by Vitality over eligibility or otherwise in relation to the Offer are final, will not be open to dispute and no correspondence will be entered into.
- Vitality reserves the right to substitute the Offer with an offer of similar value in the event the Virgin Active or Nuffield Health Fitness & Wellbeing Club memberships are not available on the terms set out in these terms and conditions due to circumstances beyond Vitality’s reasonable control.
- Vitality is not liable to any person in any way in relation to the Offer of the Virgin Active or Nuffield Health Fitness & Wellbeing Club memberships, except for any liability that cannot be excluded by law.
- Vitality accepts no responsibility for products and services provided by Virgin Active or Nuffield Health Fitness & Wellbeing Clubs.
- Vitality reserves the right to vary, extend or withdraw the Offer at any time, including in the event of fraudulent behaviour.
- This Offer cannot be used in conjunction with any other offer.
- These terms and conditions shall be governed by English law, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
