TikTok Festive Prize Draw - Terms and Conditions

a. “Draw date” means Friday 13 December 2024;

b. “Eligible Participant” means any individual who:

i) is 18 years or older;

ii) reside in the United Kingdom;

c. “Prize” means one (1) x hamper contain the following items:

i) one (1) x £270 Champneys stay for two;

ii) one (10 x £100 Waitrose & Partner voucher;

iii) one (1) x £50 Caffè Nero voucher and one x (1) reusable Caffè Nero coffee cup (RRP: £11); and

iv) one (1) x £219 Apple Watch SE GPS 40mm Midnight Aluminium Case with Midnight Sport Band – S/M

d. “Prize Draw Period” Sunday 1 December 2024 to Thursday 12 December 2024 (inclusive);

e. “Vitality” means Vitality Corporate Services Limited, the promoter of this prize draw. Vitality is registered in England and Wales with company number 05933141. The 
registered office address is 3 More London Riverside, London, SE1 2AQ.

2. This prize draw is open to all Eligible Participants who comply with these terms and conditions. It is free to enter and no purchase is necessary. Only one entry into the Prize Draw per Eligible Participant is permitted.

3. Eligible Participants are automatically entered into the Prize Draw when, during the Prize Draw Period, they follow @vitality_uk on TikTok, like the prize draw announcement post, tag a friend in the prize draw announcement comments and repost @vitality_uk’s announcement post.

4. One (1) Eligible Participant will be chosen at random performed by a computer process on the Draw Date as the winner of the Prize.

5. The winner will be subject to the terms and conditions relating to each item of the hamper, as determined by the provider of that item.

6. Confirmation of the Prize will be announced to the winner via direct message on the TikTok account used to enter the prize draw within 30 days from the Draw Date. If a winner does not respond within 7 days of being notified by Vitality, then the Prize will be forfeited and Vitality will be entitled to select another winner for the Prize in accordance with the process set out in these terms and conditions.

7. The winner will receive their Prize via post within 30 days from the Draw Date (subject to any delays that are beyond Vitality’s control). Vitality will not be liable if the Prize is lost because the winner has changed their contact details and failed to notify Vitality of this change.

8. When taking part in the Prize Draw, Eligible Participants acknowledge and consent that their name, address, email address and telephone number (“Personal Data”) will be made available to Vitality for administrative purposes. All Personal Data of Eligible Participants will be held and used for the purposes of this Prize Draw by Vitality in accordance with Vitality’s privacy notice (which can be found on https://www.vitality.co.uk/privacy/ or if not, requested from Vitality).

9. Eligible Participants are deemed to have accepted and agreed to be bound by these Terms and Conditions upon entry. Vitality reserves the right to refuse entry, or refuse to award the Prize to anyone in breach of these Terms and Conditions.

10. Any decisions made by Vitality over eligibility or otherwise in relation to this Prize Draw are final, will not be open to dispute and no correspondence will be entered into.

11. Vitality must either publish or make available information that indicates that a valid award took place. To comply with this obligation Vitality will send the surname and county of the winner to anyone who writes to Vitality at 3 More London Riverside, London, SE1 2AQ within one month after the end of the Prize Draw Period.

12. Vitality accepts no responsibility for entries lost, or unsuccessfully completed due to a technical fault, technical malfunction, computer hardware or software failure, satellite, network or server failure of any kind.

13. Vitality is not liable to any person in any way in relation to this Prize Draw, except for any liability that cannot be excluded by law.

14. Vitality reserves the right to vary, extend or withdraw the prize draw at any time, including in the event of fraudulent behaviour by any Eligible Participant.

15. Vitality reserves the right to substitute the Prize with another of similar value, in the event that the Prize is unavailable due to circumstances beyond Vitality’s reasonable control.

16. Except as set out under Clause 15, the Prize for the Winner is non-exchangeable, non-transferable and no cash alternative is offered.

17. Vitality reserves the right to amend these Terms and Conditions on the provision of written notice or via Vitality’s website.

18. The Prize Draw and these Terms and Conditions are governed by English law and entrants to the Prize Draw agree to submit to the exclusive jurisdiction of English and Welsh courts and tribunals with regard to any dispute or claim arising under these Terms and Conditions.
