Headspace Journal – Social Media Terms and Conditions 2024
1. For the purposes of this prize draw:
a) Draw Date means Thursday 28 March 2024.
b) Draw Period means from 9am on 20 March 2024 to 11.59pm on 27 March 2024 in which Eligible Participants may enter into the prize draw (entries received after this time will not be counted, valid, accepted or considered).
c) Eligible Participant means any individual aged 18 years or over and a resident in the United Kingdom, who must:
- Follow the Vitality UK Instagram page and
- Like the post by Vitality UK on the Vitality UK Instagram Page regarding this prize draw posted on 20 March 2024 and tag someone in the comments section of this post.
Any third parties or agencies connected with or involved in the administration of the prize draw will be excluded from entering the prize draw.
d) Prize(s) means the chance to win one (1) of five (5) Headspace Journal packs, which include a meditation journal, calendar, pen and badge set.
e) Promoter means Vitality Corporate Services Limited (company number 05933141) of 3 More London Riverside, London SE1 2AQ trading as VitalityHealth and VitalityLife.
f) Vitality UK Instagram Page means the Instagram page for Vitality found here.
2. The prize draw is free to enter and no purchase is necessary. The prize draw is open to all Eligible Participants who comply with these terms and conditions.
3. Eligible Participants will be automatically entered into the prize draw once they have followed the Vitality UK Instagram page, liked the post on the Vitality UK Instagram Page regarding this prize draw posted on 19 March 2024 and tagged someone in the comments section of the post. Eligible Participants can enter this prize draw multiple times.
4. The Promoter reserves the right to refuse to enter anyone into the prize draw, or award the Prize to anyone, whose social media post(s) on Instagram are, at the Promoter’s discretion, defamatory, unlawful, obscene, offensive, hateful, abusive, inflammatory, threatening, invasive of anyone’s privacy, or otherwise objectionable and/or in breach of these terms and conditions.
5. The Promoter accepts no responsibility for entries unsuccessfully completed due to a technical fault, technical malfunction, computer hardware or software failure, satellite, network or server failure of any kind.
6. On the Draw Date, the Promoter (using a random computer selection process) will draw at random the name of five (5) Eligible Participants who will each receive a Headspace Journal set (together the "Winner(s)”).
7. The Winners will be contacted by direct message on Instagram by the Promoter using the account used to enter the prize draw. The Promoter will attempt to contact the Winners up to three (3) times after the Draw Date. When contacted, the Promoter will require the Winners’ name, email address and also UK postal address in order to send the Prize. In the event that the Promoter fails to obtain confirmation from the Winners, or the Winners refuse the Prize or for whatever reason cannot accept the Prize, the original winner will forfeit the Prize immediately, and an alternative winner will be drawn and notified in accordance with these Terms and Conditions.
8. The Prize will be sent to the Winners within 2 weeks from the end of the Draw Date (subject to any delays beyond the reasonable control of the Promoter). The Prize(s) shall be sent to the provided postal address of each Winner. The Promoter will not be liable if the Prize(s) are lost in the event that the Winner(s) have changed their contact details and failed to notify the Promoter of this change.
9. When entering the prize draw, Eligible Participants acknowledge that their name (as it appears on Instagram) will be made available to the Promoter and the Winners acknowledge that their name, address and e-mail address, will be made available to the Promoter all for the purpose of administering this prize draw (“Personal Data”). All Personal Data will be held and used for the purposes of the prize draw by the Promoter in accordance with the Promoter’s privacy notice (which can be found on their website or if not, requested) and the Data Protection Act 2018.
10. The decision of the Promoter regarding any aspect of the prize draw is final and binding and no correspondence will be entered into about it.
11. Other than as set out in clause 11, the Prize is not transferable, non-exchangeable and cannot be redeemed for cash.
12. The Promoter reserves the right to substitute the Prize with another prize of similar value in the event the Prize is unavailable due to circumstances beyond the Promoter’s reasonable control.
13. The Promoter reserves the right to void, cancel, suspend, or amend the Prize where it becomes necessary to do so including in the event of fraudulent behaviour.
14. Insofar as is permitted by law, the Promoter, its agents, or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Prize. The statutory rights of Eligible Participants are not affected.
15. The prize draw will be governed by English law and Eligible Participants submit to the exclusive jurisdiction of the English courts.
16. The surname and county of the prize draw winner will be made available on request by writing to the Marketing department, Vitality Corporate Services Limited, 5th Floor, Eighty Strand, London WC2R 0DT.
