Second Nature Medication-assisted Weight Management Programme Terms and Conditions

1. For the purposes of these terms and conditions:

a) “Active” means Vitality Plan which has no unpaid premiums and which has not been cancelled by the Member or by Vitality;

b) “Health Profile” means a set of questions within the Vitality Programme and hosted on the Vitality UK App which builds a clear picture that brings together a Member’s health insights into one place;

c) “Incentivised Points” means the points awarded to a Member for participation in the Programme in accordance with clause 9 and 10 of these terms and conditions;

d) “Medication-Assisted Weight Management Programme” or simply the “Programme” means a version of the Second Nature Programme which, subject to clause 7, also provides users with discounted access (of up to 22%) to weight management medication

e) “Member” means an individual who is at least 18 years old and who holds an Active Vitality Plan and who has registered on the Member Zone;

f) “Member Zone” means the website found at https://member.vitality.co.uk/;

g) “Second Nature” means Second Nature Limited company no: 01594736 with registered address at Unit 1 Brentwaters Business Park, The Ham, Brentford, London, United Kingdom, TW8 8HQ.

h) “Second Nature App” means the weight loss and lifestyle app by Second Nature available on the ‘App Store’ for Apple devices and ‘Google play’ for Android devices;

i) “Second Nature Programme” means a 12-week lifestyle change programme provided by Second Nature;

j) “Vitality” means Vitality Corporate Services Limited and is registered in England and Wales with company number 05933141. The registered office address is 3 More London Riverside, London, SE1 2AQ, trading as VitalityHealth and VitalityLife;

k) “Vitality at Work Plan” means a programme administered by Vitality providing workplace health benefits to eligible businesses;

l) “VitalityHealth Plan” means a general insurance contract for the provision of private medical healthcare, administered by Vitality trading as VitalityHealth;

m) “VitalityLife Plan” means a pure protection insurance contract, administered by Vitality trading as VitalityLife;

n) “Vitality UK App” means the Member app https://www.vitality.co.uk/app/; 

o) “Vitality Point(s)” means the points Vitality awards to Members under the Vitality Programme when they perform certain prescribed activities;

p) “Vitality Plan” means either a:

(i) VitalityHealth Plan (including the Business Healthcare, Corporate Healthcare and Personal Healthcare Plans); or

(ii) VitalityLife Plan (including Personal Protection Plans and Business Protection Plans); or

(iii) Vitality at Work Plan;

q) “Vitality Programme” means the benefits programme administered by Vitality to which Members are offered a range of wellness and lifestyle related benefits.

2. These terms and conditions apply to the provision by Vitality of access via the Vitality Programme to Second Nature’s Medication-Assisted Weight Management Programme.

3. The Medication-Assisted Weight Management Programme is designed for certain individuals only. Therefore, only Members who meet the following eligibility criteria will be eligible to join the Programme:

(i) the Member must have completed their Health Profile;

(ii) their Health Profile must have confirmed that the Member has a BMI of 35 and over; and

(iii) Second Nature must have verified the BMI result on the Health Profile and must have determined, in its sole discretion, that the Member has a verifiable weight-related medical condition; and

(iv) the verified weight-related medical condition must be a condition which Second Nature defines as eligible for the Programme.

4. Upon completing their Health Profile, Members who meet criteria 3(ii) will be sent an email by Vitality providing them with a link to complete an onboarding quiz with Second Nature to determine whether they meet criteria 3(iii) and 3(iv) and are therefore eligible for the Programme. Upon completion of the onboarding quiz, those Members who Second Nature determine are eligible for the Programme will be guided to Second Nature’s sign-up page.

5. Upon completion of the registration process, eligible Members will get access to the Programme for 12 months (from the date they register for the Programme). After registration, eligible Members will also gain access to the Second Nature App.

6. The actual price that an eligible Member will pay whilst taking part in the Programme may vary and will be determined by the type of medication and dosage required by an eligible Member. The price of any medication offered in the Programme may also vary and is subject to change.

7. Access to the medication via the Programme is conditional on an eligible Member’s continued engagement with Second Nature. Disengagement is defined as 21 days or more of the eligible Member not replying to communications or answering monthly check-in surveys.

8. Only one membership to the Medication-Assisted Weight Management Programme per eligible Member per plan lifetime is permitted. For the avoidance of doubt, eligible Member(s) who are eligible for the Programme may also obtain a membership to the Second Nature Programme once in their plan lifetime. However, once a Member has started either the Medication-Assisted Weight Management Programme or the Second Nature Programme, they may not enrol in the other programme for at least another 12 months from the end date of the programme they had enrolled in.

9. Subject to clause 11, eligible Members may earn 1,200 Vitality Points when they sufficiently engage with their “Second Nature Coach” during their participation in the Programme. Sufficient engagement means that, at a minimum, an eligible Member has completed an initial coach call, logged a start and an end weight and completed at least 6 weekly check-ins within the first 12 weeks of the Programme.

10. Subject to clause 11 below, six (6) months after starting the Programme, an eligible Members will be invited by Second Nature to log their weight. Eligible Members who submit a weight reading which evidences that they have achieved at least a 10% reduction in their body weight since the start of the Programme (as verified by Second Nature) may earn another 1,200 Vitality Points.

11. Eligible Members will not earn the Incentivised Points for the Programme if they have already earned the maximum number of incentivised points offered through their participation in the Second Nature Programme. The combined maximum number of incentivised points an eligible member may earn by participating in either the Second Nature Programme and the Medication-Assistance Weight Management Programme (or any other programme offered through Second Nature from time to time) is 2,400 Vitality Points.

12. By entering into the Programme, eligible Members consent to their name, Vitality Plan membership number, phone number and e-mail address (“Personal Data”) being made available to Second Nature, which will be used for the purposes of administering the eligible Member’s access to the Programme. All Personal Data belonging to eligible Members will be held and used for the purposes of the Programme by Second Nature in accordance with their privacy policy (which can be found on their website or made available upon request) and applicable Data Protection legislation.

13. Participation in the Programme is subject to Second Nature’s own terms and conditions.

14. Access to the Programme is non-transferable and non-exchangeable.

15. Vitality accepts no responsibility for information that is lost, stolen or unsuccessfully completed due to a technical fault, technical malfunction, computer hardware or software failure, satellite, network or server failure of any kind.

16. Vitality reserves the right to amend these terms and conditions on the provision of written notice or via Vitality’s website at www.vitality.co.uk.

17. These terms and conditions are governed by English law and by taking part in the Programme, eligible Members submit to the exclusive jurisdiction of English and Welsh courts and tribunals with regard to any dispute or claim arising under these terms and conditions.
