Second Nature Programme – Terms and Conditions
1. For the purposes of these Terms and Conditions:
a) “Active” means that the Vitality Plan in question has no unpaid premiums, and has not been cancelled by the Eligible Participant or by Vitality;
b) “Eligible Participant” means any individual who:
(i) is 18 years old or older;
(ii) holds an Active:
1. VitalityHealth Plan (including the Business Healthcare, Corporate Healthcare and Personal Healthcare Plans);
2. VitalityLife Plan (including Personal Protection Plans and Business Protection Plans);
3. Vitality at Work Plan;
(iii) has registered on the Member Zone;
(iv) has downloaded the Vitality UK app; and
(v) has completed their Health Profile on the Vitality UK app which confirms their BMI is either 30 and over or if they have type 2 diabetes and a BMI of 25 and over;
c) “Health Profile” means a set of questions hosted on the Vitality UK app. Part of the Vitality Programme, it builds a clear picture that brings together a member’s health insights into one place;
d) “Medication-Assisted Weight Management Programme” or simply the “Weight Management Programme” means a version of the Second Nature Programme which also provides users with discounted access to weight-management medication;
e) “Second Nature Programme” means the 12-week programme provided by Second Nature to Eligible Participants;
f) “Member Zone” means the website found at https://member.vitality.co.uk/ ;
g) “Second Nature” means Second Nature Limited company no: 01594736 with registered address at 10 Malton Road, London, W10 5UP;
h) “Second Nature App” means the weight loss and lifestyle app by Second Nature available on the ‘App Store’ for Apple devices and ‘Google play’ for Android devices;
i) “Vitality” means Vitality Corporate Services Limited and is registered in England and Wales with company number 05933141. The registered office address is 3 More London Riverside, London, SE1 2AQ, trading as VitalityHealth and VitalityLife;
j) “Vitality at Work Plan” means a non-insurance product administered by Vitality which grants the member access to the Vitality Programme;
k) “Vitality UK App” means the Vitality UK app https://www.vitality.co.uk/app/;
l) “Vitality Plan” means a VitalityHealth Plan, VitalityLife Plan or Vitality at Work Plan, each a Vitality Plan and together ‘Vitality Plans’;
m) “Vitality Point(s)” means the points Vitality awards to Vitality members under the Vitality Programme when they perform certain prescribed activities;
n) “VitalityLife Plan” means a non-investment long term insurance contract or trust scheme, administered by Vitality trading as VitalityLife;
o) “VitalityHealth Plan” means a general insurance contract or healthcare trust for the provision of private medical healthcare, administered by Vitality trading as VitalityHealth; and
p) “Vitality Programme” means the system established in connection with Vitality Plans which enables members to manage, and improve-upon, their own health and wellbeing.
2. The Second Nature Programme is open to all Eligible Participants who comply with these Terms and Conditions.
3. In order to participate in the Second Nature Programme, Eligible Participants must confirm in their Health Profile that they either have a BMI of 30 and over, or if they have type 2 diabetes and a BMI of 25 and over. Eligible Participants will be then sent an email by Vitality providing them with a link to register to take part in the Second Nature Programme. Eligible Participants will be guided to Second Nature’s sign up page, where they will have to register using their name, email address, Vitality Plan membership number and phone number.
4. Second Nature will charge a one-off, £20 fee to access the Second Nature App for 12 months. Upon payment of this fee and completion of the registration process, Members will get access to the Second Nature App for 12 months and will be able to register for the Second Nature Programme.
5. Only one membership to the Second Nature Programme per Eligible Participant is permitted. For the avoidance of doubt, Eligible Participants may also obtain a membership to the Weight Management Programme once in their plan lifetime, provided they meet the relevant eligibility requirements. However, once an Eligible Participant has started one of the two Second Nature programmes (medicated or lifestyle), they may not enrol again for at least another 12 months from the end date of the first programme they did.
6. By entering into the Second Nature Programme, Eligible Participants consent to their name, Vitality Plan membership number, phone number and e-mail address (“Personal Data”) being made available to Second Nature, which will be used for the purposes of administering the Eligible Participant’s access to the Second Nature Programme.
7. All Personal Data belonging to Eligible Participants will be held and used for the purposes of the Second Nature Programme by Second Nature in accordance with their privacy policy (which can be found on their website or if not, requested) and applicable Data Protection legislations.
8. Subject to clause 9 below, Eligible Participants may earn 1,200 Vitality Points when they engage with their “Second Nature Coach” during the Second Nature Programme. Eligible Participants may earn another 1,200 Vitality Points if they achieve at least 5% body weight loss three months after completing the Second Nature Programme (together the “Incentivised Points”).
9. Eligible Participants will not earn the Incentivised Points for the Second Nature Programme if they have already earned the maximum number of incentivised points through their participation in the Weight Management Programme. The combined maximum number of incentivised points an Eligible Participant may earn across both the Second Nature Programme and the Weight Management Programme (or any other programme run by Second Nature from time to time) is 2,400 Vitality Points.
10. Participation in the Second Nature Programme will be subject to Second Nature’s own terms and conditions.
11. The Second Nature Programme is non-transferable and non-exchangeable.
12. Vitality accepts no responsibility for information that is lost, stolen or unsuccessfully completed due to a technical fault, technical malfunction, computer hardware or software failure, satellite, network or server failure of any kind.
13. Vitality reserves the right to amend these Terms and Conditions on the provision of written notice or via Vitality’s website at www.vitality.co.uk.
14. These Terms and Conditions are governed by English law and by taking part in the Second Nature Programme, Eligible Participants submit to the exclusive jurisdiction of English and Welsh courts and tribunals with regard to any dispute or claim arising under these Terms and Conditions.
