Vitality Magazine Feedback Survey - Autumn 2024
1. This Prize Draw is open to all Eligible Participants who comply with these Terms and Conditions.
2. For the purposes of these Terms and Conditions:
- “Active” means that the relevant Vitality Plan has no unpaid premiums, has not lapsed and has not been cancelled by the Member or by Vitality;
- “Draw Date” means 1 November 2024;
- “Eligible Participant” means an individual that:
- is a Vitality Member; and
- is aged 18 years and over;
d. “Member” means any individual with an Active Vitality Plan;
e. “Prize” means one (1) of five (5) ‘Waitrose & Partners’ E-Gift cards worth one hundred pounds (£100) which can be used both in-store and online;
f.“Prize Draw” means the random selection of five (5) Winners to win the Prize on the Draw Date in accordance with clause 6;
g. “Prize Draw Period” means 00.01am 20 September 2024 to 23.59pm 31 October 2024 (inclusive);
h. “Vitality” means Vitality Corporate Services Limited (registered number 05933141) of 3 More London Riverside, London SE1 2AQ trading as VitalityHealth and VitalityLife;
i. “Vitality Plan” means a “VitalityHealth” private health insurance plan, and/or a “VitalityLife” life insurance plan administered and arranged by Vitality; and
j. “Waitrose” means Waitrose Limited, a company with registered company number 00099405 and registered office at 171 Victoria Street, London SW1E 5NN.
3. Vitality will circulate the Vitality magazine to its Members via email, using the email address registered on a Member’s Vitality Plan and via the Vitality Member app on 20 September 2024. The Vitality magazine will contain a link to [VCSL3]Vitality’s 2024 magazine feedback survey (the “Survey”) (available through an online Microsoft form).
4. Eligible Participants will automatically be entered into the Prize Draw once they complete the Survey within the Prize Draw Period.
5. Only one (1) entry into the Prize Draw per Eligible Participant is permitted.
6. On the Draw Date, Vitality will use a computer generator to randomly draw the name of five (5) Eligible Participants, who will receive the Prize (the “Winner(s)”).
7. The Winner(s) will be subject to the terms and conditions relating to their Prize, as determined by Waitrose, the provider of the Prize.
8. Vitality will email the Prize to the Winner(s) using the email address provided on the Survey within thirty (30) working days from the Draw Date (subject to any delays beyond Vitality’s control).
9. The Winner(s) can use the Prize upon receipt. Vitality will not be liable for any lost Prizes in the event that the Winner(s) have changed their email address and failed to notify Vitality of this change.
10. When taking part in the Prize Draw, the Eligible Participant acknowledges and consents that their name and email address (“Personal Data”) will be made available to Vitality for administrative purposes. All Personal Data of the Eligible Participant will be held and used for the purposes of this Prize Draw by Vitality in accordance with Vitality’s privacy notice (which can be found on https://www.vitality.co.uk/privacy/ or if not, requested from Vitality) and applicable data protection legislation.
11. Eligible Participants are deemed to have accepted these Terms and Conditions upon entry. Vitality reserves the right to refuse entry, or refuse to award the Prize to anyone in breach of these Terms and Conditions.
12. Any decisions made by Vitality over eligibility or otherwise in relation to this Prize Draw are final, will not be open to dispute and no correspondence will be entered into.
13. Vitality accepts no responsibility for entries lost, or unsuccessfully completed due to a technical fault, technical malfunction, computer hardware or software failure, satellite, network or server failure of any kind.
14. Vitality is not liable to any person in any way in relation to this Prize Draw, except for any liability that cannot be excluded by law.
15. If Vitality reasonably suspects any Eligible Participant to have committed or attempted to commit an act of fraud or dishonesty , the Eligible Participant will:
a. receive no Prize; and
b. repay to Vitality upon request the monetary value of the Prize if this has already been received by the Eligible Participant.
16. Vitality reserves the right to vary, extend or withdraw this Prize Draw at any time, including in the event of fraudulent behaviour by any Eligible Participant.
17. Vitality reserves the right to substitute the Prize with another of similar value, in the event that the Prize is unavailable due to circumstances beyond Vitality’s reasonable control.
18. Except as set out under clause 17, the Prize is non-exchangeable, non-transferable and no cash alternative is offered.
19. Vitality reserves the right to amend these Terms and Conditions on the provision of written notice or via Vitality’s website.
20. The Prize Draw and these Terms and Conditions are governed by English law and Eligible Participants submit to the exclusive jurisdiction of English and Welsh courts and tribunals with regard to any dispute or claim arising under these Terms and Conditions.
21. Vitality must either publish or make available information that indicates that a valid award took place. To comply with this obligation, the surname and county of the Winner(s) will be made available on request to anyone who writes to the Marketing department, Vitality Corporate Services Limited, 5th Floor, Eighty Strand, London WC2R 0DT within one month after the end of the Prize Draw Period.
22. Vitality is the promoter of this Prize Draw.
