- The Offer is open to Eligible Members who comply with these terms and conditions.
- For the purposes of these terms and conditions the following definitions apply;
- “Active” means that a Vitality Plan has no unpaid premiums, has not lapsed and has not been cancelled by the Eligible Member or by Vitality;
- “Callaway” means Callaway Golf Europe Ltd, a company registered in England and Wales with the registered number 2756321 and registered office 1 Blossom Yard, Fourth Floor, London E1 6RS;
- “Callaway Preowned Website” means https://eu.callawaygolfpreowned.com/gb/en-gb;
- “Callaway Website” means https://eu.callawaygolf.com/en/gb;
- “Discount(s)” means the following discounts applied on the advertised retail price of the below products sold by Callaway on the Callaway Website or the Callaway Preowned Website available for use by each Eligible Member during each Reward Period:
Discount(s) on the Callaway Website:
- 10% off new golf clubs, Vitality golf balls and accessories (towels, hats, head covers and gloves) and 20% off accessories from the Vitality Range
Discount on the Callaway Preowned Website:
- 20% off pre-owned Callaway golf clubs
- “Eligible Member(s)” means anyone 18 years old and over with an Active Vitality Plan who:
- is a resident of the United Kingdom or a British Crown Dependency;
- is registered on the Member Zone;
- has completed their Health Profile.
- “Eligible Purchase(s)” means any purchases made by an Eligible Member using the Discounts via the Callaway Website and or the Callaway Preowned Website
- “Health Profile” means the feature within the Vitality UK App which shows Vitality members a clear picture of their current health with tips on how to improve it, following Vitality members completing an online health questionnaire in their current Plan Year;
- “Plan Year” means normally, the initial twelve‑month period beginning on the start date of an Eligible Member’s Vitality Plan and ending on the first anniversary of that start date and each subsequent twelve‑month period thereafter.
- “Reward Period” means each a 90 days during each Eligible Members Plan Year;
- “Vitality” means Vitality Corporate Services Limited and is registered in England and Wales with company number 05933141. The registered office address is 3 More London Riverside, London, SE1 2AQ, trading as VitalityHealth and VitalityLife;
- “VitalityHealth Plan” means a private medical insurance plan or healthcare trust administered and arranged by Vitality; also including Vitality Health Lite, Vitality Essentials and Vitality at Work.
- “VitalityLife Plan” means a non‑investment long‑term insurance contract or trust scheme, administered by Vitality;
- “Vitality Plan” means a VitalityHealth Plan, VitalityLife Plan , each a Vitality Plan and together ‘Vitality Plans’;
- Vitality Programme means the system established in connection with Vitality Plans which enables members to manage, and improve upon, their own health and wellbeing;
- “Vitality UK App” means the Vitality member app, used to host the Vitality Programme, where Vitality members can track their activity, manage their Vitality Plan and engage with the Vitality Programme.
3. During each Reward Period, each Eligible Member:
a. will be able to redeem and use no more than one (1) of each Discount, the Discounts to be made available via a voucher in the Vitality UK App; and
b. is only entitled to one (1) of each Discount even where an Eligible Member is covered under more than one (1) Vitality Plan.
4. The Discounts will be subject to the following restrictions:
a. The Discount will be applied to the advertised full price off products to which the Discounts can be applied on the Callaway Website or Callaway Preowned Website.
b. Each Discount may only be applied to one transaction each every Reward Period and unused Discounts cannot be carried over to the following Reward Period.
c. The relevant Discount will be applied to the total cost of the transaction where multiple items are being purchased. In the case of new items, a single voucher code will be applied to clubs and accessories which will apply the relevant Discount percentage at checkout.
d. Outlet is excluded from the Products on the Callaway Website, whilst on Callaway Preowned Website outlet is included.
e. This Offer is subject to Callaway’s own terms and conditions, and Vitality will not be responsible for any actions, representations, omissions or defaults by Callaway in relation to the Discount.
5. The Discounts can only be utilised by Eligible Members. Any re-sale or distribution of any items purchased by an Eligible Member to other persons is a breach of these terms and conditions. We reserve the right to take action consistent with our legal rights against any Eligible Member in the event of any suspected breach of this paragraph 5 or suspected dishonest or fraudulent behaviour by an Eligible Member.
6. If an Eligible Member covered under a Vitality Plan is aged under 18 during a Plan Year, then at the commencement of the Plan Year immediately following that Eligible Member’s 18th birthday, the Discounts will be allocated to their own Vitality membership details subject to all eligibility criteria being met.
7. Delivery charges are excluded from the Discount and delivery is not available to Channel Islands.
8. Any decisions made by Vitality over eligibility or otherwise in relation to this Discount are final, will not be open to any dispute and no correspondence will be entered into.
9. Vitality accepts no responsibility in the event that an Eligible Member is unable to redeem their Discount(s) or is otherwise unable to take up this Offer, for any reason that is outside of Vitality’s control including but not limited to any technical fault, malfunction, hardware or software failure or network or server failure of any kind
10. Vitality is not liable to any person in any way in relation to this Offer, except for any liability that cannot be excluded by law.
11. Insofar as permitted by law, Vitality and its agents will not, under any circumstances, be responsible or liable to compensate any Eligible Member or accept any liability for any loss, damage, personal injury, or death occurring as a result of an Eligible Member’s use of the discount pursuant to these terms and conditions. The statutory rights of Eligible Members are not affected.
12. Subject to clause 13 below, the discounts are non-exchangeable, non-transferable and no cash alternative will be offered.
13. Vitality reserves the right to substitute the Discounts with another discount(s) of a similar value.
14. Vitality reserves the right to refuse to award the Discount to anyone in breach of these terms and conditions.
15. Vitality reserves the right to amend these terms and conditions on the provision of written notice or via Vitality’s website.
16. All personal data of Eligible Members will be held and used by Vitality for the purpose of promoting this Offer in accordance with Vitality’s privacy notice (which can be found onhttps://www.vitality.co.uk/privacy/) and data protection legislation.
17. Vitality is the party legally responsible for this Offer as the promoter.
18. This Benefit and these terms and conditions are governed by English law and Eligible Members submit to the exclusive jurisdiction of English and Welsh courts and tribunals with regard to any dispute or claim arising under these terms and conditions.
